PAM member wins extra hours case – employer in breach of obligation to offer extra hours
The right of part-time employees to get available extra working hours is a concern for service sector workers. On Friday 30 November the District Court found in favour of a part-time employee who wanted extra hours.
According to lawyer Mika Ojanen, the matter was about whether an employer is required to offer extra hours. Three part-time workers were employed in the Kouvola shop of Emmaljunga Finland. One of the part-timers quit and was replaced by a new employee who got more hours than the member who brought the case to the union.
The District Court considered that the obligation to offer extra hours had been breached, since offering extra hours was not impossible or inappropriate.
