Rosters in hotel, restaurant and leisure services

A displayed roster cannot be changed without the consent of the worker and the employer.

Rosters (or shift schedules) must indicate details such as the names of employees, the start and end times of working days, and days off over a three-week period. A roster must be displayed no later than one week prior to the beginning of the three-week period concerned.

Each three-week period always starts on a Monday. Once displayed, a roster must not be changed without the consent of the workers and the employer. Rosters must always be drawn up by means other than a pencil.

A three-week period includes a maximum of 15 working days. For each week of five working days, employees earn two days off: a weekly rest day (‘V’) of a minimum of 30 hours, which must be given for each full week of work, and an additional day off (‘X’) of a minimum of 24 hours, which may be postponed from one week to another within the same three-week period.

In addition, the sector is governed by various provisions on working hours applicable to full-time workers, which the employer must observe when drawing up rosters.

If amending a roster results in overtime (such as in the event that a co-worker becomes ill), employees are not obliged to consent to this.

If the employer requires additional workers for duties suitable for existing part-timers, such work must be offered even after displaying the roster.

Inexpediently short shifts should be avoided. No shifts of less than 4 hours may be used, except where required by a worker’s needs or for some other justified reason.
